Update On The Lawsuit
Thursday, April 7, 2011
GoBeOnTv,My Talent Services,Be Productions ,Advance Fee Rip-Off: Here's a surprise...the web site set-up after the good people of Texas were taken is now dead!
Here's a surprise...the web site set-up after the good people of Texas were taken is now dead!
When the crew went to Texas they took the time to set-up a web site that had kids posted and made it seem that they were "earning" the money that they took, and more than likely were doing their best,to take more. The web site they set-up is dead, and takes you a German web site. Funny how it still uses the "gobeontv.com"...

Be Productions,2 years later and the lies continue. Legal before yes,now no..Ethical? NOT
This person's page goes on to have comments by people that "claim" to have links sent to them. One person even said " A while back I got a random fb message that included inks to different pages" Another person claimed to get "a long message" Also the person that took advantage of my family when we were first sold our contract with Be Productions wants to "time to tag team" and the same person who has the page even say's
"the irony is this fools kid worked on one of my tv shows"
As stated before, the past owner of Be Productions has made threats of the above to me. As a matter of fact, the person that sold us our contract with Be Productions pleaded with me to remove his name from the blog and the actual e-mails that were sent to us,because he had kids in collage. It is sad when many parents and yourself lose thousands and it is excused as "a prior" business. A prior business that may have legally sold contracts to Monterey Financial Services. But was that explained to anyone? No. Were they told when the business closed and moved to LA? No. If you look at one of the links,it show's the sign that was left on the office door in Emeryville..that was it. Did they tell anyone when they closed business in LA?..no again. Did the name change to My Talent Services..yes. Strange, this "business" started with My Artist's Place then Be Productions and them My Talent Service's. Was it legal, sure. Ethical? You be the judge.
The links on this blog are the truth, not make believe. As in the case, where if the person who is described as "the fool who's kid worked on one of my tv show's". WHERE IS TRUTH? You can go to http://www.imdb.com and search for Be Productions. Note the last tv show was 2007!..funny my son was signed in 2008..a year AFTER the last tv show!
In closing, take the time, read the blog and start at the beginning. Check out the links. My story tells you what my family and I went through. The e-mails are real and have been saved and put away. The sad part is,again..was it legal? Not anymore.
Was it ethical? You be the judge. Did a lot of families have their credit effected? Yes without a doubt. Did families either did not get paid as promised and lost money? Yes. And they will walk in a court of law with me and testify to that FACT.
After this blog was created,a year later Texas had almost the exact same thing happened again. People were approached at Mall's and Target. Read the blog, the same people were their. Check out the link http://gobeontv.com..nothing updated since 2009..legal maybe..ethical..again you be the judge. Thanks DC and MH for the "heads-up" on this.

The threats keep comming
******* said.....
hey if anyone gets contacted by a guy who is bad mouthing me about a prior business please let me know as i am preparing a case against him for defamation and other offenses and i need witnesses...thanks!
Wow..if anyone get's contacted by a guy who proclaims this blog is not right, let me know..the truth will alway's prevail!
Also keep in mind:
HE has to prove that you had malice, were lying, etc. He has to prove that BEFORE discovery (the phase where witnesses enter the picture and depositions are taken and where he can ask you for your files). And if he loses that SLAPP case, it will cost him ALOT of money. You can collect double all your attorney fees.
Give it a rest buddy.

Some Words of Advice from bizparents
--I'm thinking that there may be parents reading who are still interested in the entertainment industry for their kids, but don't know how to go about it legitimately. Our website could help them, for free. We also have a FREE newsletter that we send out about once a month or so. Parents can sing up for that on the bottom right of our homepage at www.bizparentz.org.
--As you have noted many times, there appear to be quite a number of "secondary scams" involved in Be. Those are businesses that have either obtained the Be mailing list or are owned by related businesses and are STILL out there to get your money. Be victims have a bit of a target on their head. Don't be taken again!
I suggest that parents check out the link that the Dept of Labor has published in relation to the new anti-scam law, the Krekorian Act. Wtih this new law, businesses similar to Be would have to post a bond with the state. That way, if they run with the money, victims would have some recourse. This applies to any business that charges upfront fees to actors (a practice which is highly discouraged, which is why there is a law about it).
The new DLSE list was just published. It is on this page on our website:
http://www.bizparentz.org/entertainmentlaws/krekorianact.html
If I understand their business model correctly, businesses like Rising Stars and Hollywood East, should have posted a bond. If they didn't, parents should not be working with them.

Update on the law suit
http://www.archive.org/download/gov.uscourts.cand.218362/gov.uscourts.cand.218362.93.0.pdf
This link is the latest amended claim. Mr.Preston did request in the letter that if you have not sent these to him,he would appreciate if you were able to provide a copy of your contract with Monterey or if you have a copy of your credit report which reflects a derogatory entry by Monterey. They are also interested in speaking to anyone who made direct payments to MTS Holdings Group,Inc. They also went by My Talent Services (as noted in this blog). Also if you have not sent Mr. Preston your contract with Be., LLC, please do so.
Remember, the amount of money many parents and I were out,was substantial. Someone took advantage of all of us and our children. If you can, please help Mr.Preston and all involved send a message out, that what was done to us was not right, and will not be tolerated. I know it seems the wheels of justice are going slowly, but at least they are still running. Please contact Mr. Preston if you can help out,if not for yourself, maybe for someone else.
Thanks

GoBeOnTV.com Texas Scam
It was August of last year (2009) that after the people that were responsible for the Be Productions Scam aka My Talent Services Scam aka GoBeOnTV.com scam hit Texas. Many parents contacted this blog when they were approached at Malls and Target Stores. The method changed slightly,as they stayed away from the amusement parks (like Marine World here),but the bottom line was the same. Promise the chance to be on tv or movies, pay a fee up front (for pictures, lessons) or in the Texas case, wow be on their web site. Were they told that when your picture was put on their web site, that that site now owns the rights to YOUR PICTURE. This is a reminder to everyone with children, that it's almost summer, and the bottom feeders will be out. If anyone was taken by what happened in Texas, please feel free to post that on this blog.
Remember that parents that found the Be Productions Scam blog, were almost ready to be taken. After reading the blog and seeing what happened to not only my family, but many others, that saved their family from the pain we went through. Who knows where they will strike this summer?..Just watch some of those same names..Erik,Sal,Kim and Lisa to name a few..

Latest From Hollywood East Productions
From the desk of Martin Herrera
Hollywood East Productions: Reality Show Update
Hello Everyone.
Current update: We are still conducting pre-workshop telephone interview/reviews now. I am monitoring, editing and correcting the talents/child’s slate introductions, commercials, monologues, songs and over all breakdown of your on camera performance, as related to their Actors/Slate DVD and stage performance.
Parents, I need to talk to you, and I need to listen to your child as soon as possible. Many of the children have called in and I am assisting them. I need to hear from you and your child, if I’ve not talked to you as of yet. I am waiting for your call or e-mail reply. Thank you.
Also, I want to “Thank” all the parents for calling in and for asking their many questions and production concerns. You should always feel free to ask, any and all questions that need your attention.
I would also like to say to all the talent that I have talked to thus far, “WHAT AN AMAZING JOB YOU HAVE DONE”. You have taken what skills you have learned and excelled greatly within our pre-rehearsal talks into true actors. And for those of you who wrote your own monologues, GREAT JOB! NOW THAT’S TALENT!!!
Parents, I will be closing this production offer soon. We need to move forward with our workshop dates and venue locations for this March. We are scheduled to shoot in April, after the Easter holiday. Please e-mail me with your talent/child’s telephone interview time as soon as possible.
Workshop location details: After speaking with many of you over the past weeks. It looks like we will be conducting the workshops for Northern CA, in the Pleasanton/Dublin, CA. area. And, for Southern CA, it looks like we’ll be in the San Clemente area, boarding between San Diego, Orange County and the Los Angeles area. I am still open to suggestions. Remember, we will conduct a full day’s workshop session on Sunday’s only, since many of you work on Saturday’s. Times are 9am to 5pm. However, should your child still want to go over or cover different aspects of their performance? I am always available on the phone.
ALSO, a friend of mine who work at DISNEY STUDIOS has asked me, if I wanted to come to tapings of some of their new shows. I don’t have the time. But, would you like to be invited? This way, I can have your name added to their studio listing for audience seating, when they resume taping. Or, would you be interested? Sorry, I don’t know the names of the shows.

Martin Herrera and Hollywood East Productions..Another Rip Off In The Making?
Again, if you pull-up Martin Herrera's name on this blog, you will find a e-mail he sent me explaining how he was "hand picked" by Erik, when Be shut down, and MTS appeared. Now MTS is gone, and now we have Hollywood East Productions. New name, same player. Attached is a e-mail Martin had the nerve to send to My Talent Services Parents, after they shut down. Does anyone notice a TREND here. This group treats everyone like they are stupid, and will continue to be TAKEN. I will continue this blog and continue warning parents as long as this gang continues to prey on innocent people. Don't be surprised if at some point a: BeOnTv merges with Hollywood East (maybe poor Erik won't be Broke) or another new name..it's anyone's guess. $200 a person..wow.what a deal Martin.
From the desk of Martin Herrera
Hollywood East Productions: Reality Show Update
First off, I’d like to say “Thank You” To each and every one of you. Not only for your kind words throughout this turn of events, but for your thoughtfulness and wonderful support shown towards me. But most of all, for your commitment to your children, to see them through to the next step, as we guide them forward in their journey, through this, the entertainment industry.
As many of you know, we are now confirming the workshop details for this project. We are currently in the preproduction stages of listening to the talent/kids conduct their slate/acting scenes over the phone. Within this process, I am also correcting any and all errors that they may have learned along the way.
Parents, please e-mail me as soon as possible, with a date and time, so that I can listen and assist your child over the phone. We need to move you through to the next step, before we start the Actor/Slate Workshop. (Please note) This is not the same process of Slating that you’ve learned before. It is structured in some parts the same way, but it’s performed slightly different, and we will directly enhance and target the Slate specifically for your talent/skills in the industry.
Schedules for the workshop sessions will be e-mailed to all confirmed talent, by the seconded weekend of February. Please continue to send in your confirmations, so that we can get you on our books as CAST.
Many parents are sending in their workshop fee now. So as not to break the bank, a session fee of $200.00 is required to hold your spot for the weekend workshop. After talking with many parents, I find it best if you pay for play as we move you and your child forward. I want this to be a stress free project in which you will properly learn and, be thoroughly trained by the end of this preproduction workshop in order for you to perform at your highest level as an entertainer.
For those of you who have sent in your confirmation replies. I will be sending you, your follow up details and preproduction workshop guides. Once we have all talent confirmed in their general areas, we will begin with sending you, your workshop dates, times and venue locations.
Now for some other news, Sunday night I had the privilege of attending Justin Timberlake’s, Grammy Award VIP after party in Hollywood. I have set-up phone meetings with an entertainment publicist and the Head VP of development at FOX. I’ve pitched our project to both parties and both are very interested in viewing our show. Throughout this month, I have been talking to people at different functions, promoting the show as it were. Just by my enthusiastic pitch and production knowledge, we have already produced a fan base. After doing much research, I have found our only other possible competition could be A&E’s “Toddlers and Tiara’s or “Little Miss Perfect”. HELLO!! I don’t see any real talent on their stages, at least performance wise. What do you think?
I am so excited for this project to just blow up. We will be shooting in April, in order to be a mid-season replacement. Let’s get moving. We have much work to do. I can’t wait!!! Please get your confirmations in NOW. THANK YO

Follow-up email on class action lawsuit against Be., LLC
This is a brief follow-up email regarding the class action complaint against Be., LLC and others.
As the February 4, 2009 email mentioned, we are planning to ask the Court to certify the case as a class action. As part of that effort, we are asking you to please send us copies of your contracts with Be., LLC and/or Monterey Financial Services, LLC. Additionally, some of you may have marketing materials from Be., LLC. Please email us your contracts and other materials to gonnabe@eplaw.us or fax them to (312) 262-1007. Please be sure to separately include your name and the date you signed your contract with Be., LLC in your email or in the fax cover sheet.
Additionally, we are investigating whether or not Monterey Financial Services, LLC may have recorded or monitored calls without disclosing that the calls were recorded. If you received calls from Monterey Financial Services, LLC which did not explicitly disclose that the call was recorded, please email your name, telephone number, and the approximate dates of the calls from Monterey to monterey@eplaw.us.
Many thanks,

Class Action Law Suit against Be Productions,a message from Ethan Preston

From:
Ethan Preston

To: Ethan Preston
Dear Parents,
This email contains information about a class action complaint against Be., LLC and several other related businesses and people. We are writing to update you on the progress of the case because you have contacted one of the attorneys at my firm, or at the co-counsel firms also involved in the case (Parisi & Havens LLP and Bramson, Plutzik, Mahler & Birkhaeuser LLP). You can read a copy of the complaint here:
http://www.archive.org/download/gov.uscourts.cand.218362/gov.uscourts.cand.218362.1.0.pdf
We are currently focused on the following Defendants: Monterey Financial Services, LLC., 1901 Co., Jacob Steinbeck, My Talent Services (also known as MTS Holdings Group, Inc.), and its owner Vitaly Rashkovan. We would like to hear from anyone with any additional information about these Defendants (beyond what is in the Complaint). If you have any information about these Defendants, please email me with a brief description at your earliest convenience. It is important that you email us, so that we can assign the right person to speak with you as efficiently as possible. One of our priorities is gathering information from anyone interacted with My Talent Services. We also know that many parents refused to continue paying their service fees to Monterey Financial Services, LLC after seeing the 7 On Your Side newscast on Be., LLC. (You can see the 7 On Your Side Newscast here: http://abclocal.go.com/kgo/story?section=news/7_on_your_side&id=6345835) Another priority is gathering information from anyone who discussed the newscast with any of Monterey Financial Services, LLC's employees.
You do not need to contact us at this time to ensure that you are included in the class action. You do not need to "opt-in" to the class at this time. (Please understand that hundreds of people have contacted us. We understand many of you are very upset with the Defendants' actions and want to ensure you are included in the class action, but there is no need to do so and individually speaking with each parent would take a significant amount of time away from the legal work that needs to be done in this case.) We will do our best to keep you informed on the general status, but because we do not directly represent each of you (prior to class certification), we have to be careful not to divulge information protected by the attorney-client privilege.
While we do seek to represent all of the customers that paid money to Be., LLC, at the current time we only represent the two clients individually named in the lawsuit. The usual rule is that class members who do not actively opt out are automatically included in the class action. If and when the Court certifies the case as a class action, you will receive formal notice of the lawsuit and be given the opportunity to opt out. We hope to identify all of Be., LLC's customers from the Defendants' records (not just the parents who have contacted us). If those records will not provide that information, we will contact you again for your help in documenting your claims.
Sincerely,
Ethan Preston

Sighting in Seattle?
They are in Seattle doing a "Casting Call" at the Tacoma Washington Marriott Courtyard
Today's date, 2 hr's ago..if anyone has something to post on this..let me know..let's save some parents and kids some heartache!

Hollywood East Productions it was My Talent Services it was Be Productions it was My Artist Place When will it end Martin Herrera?
This was sent by a parent from the LA area:
Hi Scott,
This Martin Herrera is a major scammer. MTS is no more, as it is now being call Hollywood East Productions. My daughter went through the BE/MTS auditons back in August. I had a feeling it was a scam when he called my wife saying that my daughters monologue was age inappropriate, and we got it out of kids monologue book??!
Well, we got a email from martinathollywoodeast@gmail.com. It said that had been accepted to shoot on a upcoming reality TV show, but in order to be able to shoot, she had to go to 2 3.5 hour classes (and it didn't have to be acting, it could be modeling, singing, dancine). Then she could do the free shooting.
Now is with JE Model and Talent in SF, and we have always done auditions, then if picked, do the shooting. We never had to pay to shoot, but we always get paid.
To add more to the scam, you can pay 125 bucks for headshots. Why?? We don't need them. You can also buy a copy of the shoot you do for 40 buck. Or for 100 bucks you can order your child slate. This is definitely a scam tht everyone needs to watch for.
If you like to see the email sent, Let me know and I can forward to you. I will just need an email address to forward it too.
Also, one more thing, I am glad to see that ripoff Gonnabe.com is gone. The so called webmaster, Nicholas Fordham, used many scripts to move people too fast, especially at the end, plus he set up bogus accounts. I hope that he never finds a legit job, because he is to easy to catch.
This was sent by the same parent. Look closely..it's Martin from My Talent Service:

Martin also sent this out to "select" parents, here are some of the comments so far:
Wow!! This is pretty sad.....
I feel bad for anyone who still thinks this is the real deal. I can't believe they just keep changing the company's name. What is this....like the 5th time! It's just crazy, and appears to have no end in sight....
Sent on the Sprint® Now Network from my BlackBerry®
Lies, lies, lies...
First, the BE Web site is alive and well at http://www.gobeontv.com/. Next, this lying sack of shit can't even spell the name of a previous employer... "John Paul Gaultier" instead of "Jean Paul Gaultier", not to mention the ripped tendon in his "angle".
I sure hope none of you entertain the prospect of registering for this continued scam....
From the desk of Martin Herrera
Happy New Years Everyone
I am sending this notice to all the children and families who auditioned for the new Reality Show which is associated with Hollywood East Productions solely and no one else.
As many of you know, during this holiday season starting from the Thanksgiving weekend, the BE, LLC web-site was removed from the internet.
Parents and Children: a production notice on Thursday Dec 31, 09 regarding this production change was sent to you. After all your hard work, amazing talent, practicing and determination we just couldn’t pull the dream of producing your own Reality Show out from under you.
We want to continue producing this project for you and with you. Many of the children mentioned and expressed they wanted to model, dance, act, sing or do their own gifted talent. We want you to do just that. As noted and stated in many of the Audition/Evaluations returned, I said that I would train the children in Modeling/Fashion Runway and polish up their Dance routines.
A brief Bio on my background - I started Modeling professionally at 18 yrs, doing Runway Collections for designers such as: Bill Blass, John Paul Gaultier, MEN, Perry Ellis, Armani, Macy’s, Dolce & Gabbana, Union Bay Sportswear, GQ and ELLE Magazines, the International shows along with countless other clients.
My dance background is just as vast. Due to a sudden baseball injury, I was led to take dance workshops to fix a ripped tendon in my angle. Where I studied Ballet, Jazz, Modern Dance, Space Movement and Hip Hop Styles which allowed me to assist the choreographer in my first fashion show at 18 yrs. Whereas, I was hired directly thereafter as the choreographer for my second show. I stopped modeling at 25 yrs when I became an Agent in the Seattle, WA area.
After managing models and talent in the Seattle market, I moved back home to Los Angeles, CA. Geared with my booking skills and contract knowledge, I was hired to scout and send models to Europe and Japan before becoming a casting agent/director, for Feature films, Commercials, Music Videos and national advertising agencies.
As for our Acting Coach and Singing Coaches, we have some of the best in the business available to provide their services to us. These professionals work daily in their creative field. Teaching and providing the needed skills to actors and singers. They are classically trained vocally and instrumentally. Studio Engineers and stage performers with projects and staged tours added to their resumes. We just need to give them the word when we’re ready to start the workshops.
As for the structure of the Reality Show, we will film all the kid’s doing their Slates, Scripted Scenes, Dance Routine, Singing, Variety Skits, Modeling in a fashion show and all the behind the scene antics you and your family can provide.
Parents and Children we will also have a confessional area available for those who want to express their experience good, bad or indifferent of the entertainment industry. (you will not be allowed to slam BE’ LLC/MAP. Due to legal matters) But we will want to hear your success stories, your truths and your future goals from this day forward.
While shooting the new show we want all of you to express a wide variety of skills and animation in your acting and talents. You never know who might be the Breakout star of the show. We want everyone to shine. Just be yourself and when you see the camera on you. GO FOR IT! Our goal is to produce an entire season with what we shoot, allowing everyone to have camera time. However we need to first shoot the pilot to get picked up.
Parents, I would like to take the time and talk to everyone of you before we start production, should you have any question(s) and or concerns before we start the workshop training and production shoot. Thereafter we will send out production times and venues for workshops and production schedules for venue shoots. We are looking at workshop training and production shoots on the weekends only. As of now we would like to focus our target dates for March 2010, once we complete the workshop training.
Thank you for your time and your patience’s.
Sincerely,
Martin Herrera

Watch out..they are everywhere
Wendy has left a new comment on your post "Be Attacks Texas/Austin was the last HIT!":
I'm glad that I read this blog. I took my daughter in for an audition in San Francisco back in October to audition for Adrian R'Mante TV Commercial and Network. We never heard back and I just got a call today from Anthony with the number 408******* saying that my daughter got chosen to be part of the Adrian R'Mante network. I didn't pick up and he had left me a voicemail. Before I called back, I researched it and found this blog. I called him back to see what he would say and he said that 30 kids were chosen to be part of this network. They would work 2 days with Adrian and the other days with other stars. I asked him how much it cost and he said, packages start at $750. I told him that I would have to discuss it with my husband, but seriously, there's nothing to discuss. I'm not calling him back. Be careful out there, they're back in Northern California.

7 on Your Side Exposes Be Productions Again
Talent agency sued over illegally taking money
http://abclocal.go.com/kgo/story?section=news/7_on_your_side&id=7185004
Here is the written story:

A federal class action lawsuit now pending in San Francisco accuses a company called "Be Productions" of illegally taking money from thousands of California families.
Mason Fang likes the idea of being onstage, even if he is just playing Rock Band with his mom and sister.
Mason thought he was getting his big chance when a talent scout approached him on the street with a pitch that Be Productions of Emeryville was casting for TV shows.

Story: Talent agency's business practices questioned
"Wow, I'm going to make it on television, maybe a movie," he said.
He took a screen test, got a call back, and then his mother found out Be Productions required a $2,500 fee up front. Dongna Fang did pay, but soon after, regretted it.
"I find out, we end up paying I pay more and more money down the road," she said.
Fang tried to get her money back. But Be Productions said she missed a three-day deadline to cancel her contract.
She was among dozens of parents who complained to 7 On Your Side, saying what they thought was a TV audition turned out to be a costly sales pitch.
"I got slammed with the price," said Sandra Flores.
"After I came home, the reality kicked me in the butt. I can't do it, I can't afford it," said Corina Flores.
"It went to the thousands and really that's a lot of money," said fourth grader Arthur Poggenburg.
Now Be Productions is facing a federal class action lawsuit filed on behalf of an estimated 6,000 children who signed up just like Mason did.
"I was approached by consumers who had a bad experience with Be," said attorney Ethan Preston.
Preston is the Los Angeles area attorney handling the case, which he says was sparked by a 7 On Your Side investigation.
"I think it got consumers activated and empowered and it probably ultimately led to this lawsuit being brought," he said.
The suit says: "one of the best summaries of the case can be found in a newscast investigation into Be Productions by the ABC affiliate station for San Francisco."
In our report, we pointed to a tough state law that provides broad protections for consumers.
It says advance fee talent companies must follow a lot of rules such as:
* Register with the state
* Post a $10,000 bond
* Give consumers 10 days to cancel and refund all money if customers don't get expected services
Be Productions did none of those things and the suit says contracts signed by Dongna and thousands of others "violate the law and cannot be enforced."
"It's surprising it went on as long as it did, because they were so flagrantly in violation of the law," said Preston. "The contracts didn't comport with the law. The law said they had to do certain things and they just didn't.
Be Productions isn't even operating anymore. The offices in Emeryville shut down last May.
Customers were referred to a phone number in Southern California, now that phone is disconnected and the website is shut down.
"$2,500 it's not small money, plus we didn't get any service," said Fang.
Be Productions co-owner Barry Falck did not return our calls. We did reach co-owner Erik DeSando and he said only "I haven't been served" and he ended the call with an expletive.
In July 2008, Desando told 7 On Your Side his company is not an advance fee talent service. Yes it charged fees up front, but it didn't provide the actual talent services, such as classes, photo shoots and auditions.
"Those things you're talking about they're being done, but they're being done by outside companies not ours. So in other words, if you want to meet an agent through us, you can't meet an agent through us. You can meet an agent through the showcase company we contract with," said DeSando in July 2008.
But our investigation showed DeSando and Falck in fact owned the showcase company, Dynamic Showcases.
The lawsuit also says Be Productions also was getting paid compensation for referring kids to classes and photo shoots -- something the law forbids.
The suit also says those initial screen tests were misleading -- kids were selected not for their talent but for their financial ability to pay.
"A lot of kids dream of being in the entertainment industry and those dreams are very easy to exploit for people who are not scrupulous," said Preston.
Kids and parents paid up to $5,000 apiece to Be Productions. The attorneys are trying to locate what could amount to more than $20 million families paid to be.
"There are a lot of angry, very angry consumers," said Preston.
"And now we're trying to get our money back as well as maybe thousands of people," said Poggenburg.
"I really hope we can get money back," said Fang.
A federal judge has now frozen the assets of be productions until all of this is sorted out.
If you want to be a part of the class action lawsuit, you do not have to do anything. If you were are customer, you're automatically a part of it. You only have to take action if want to opt out of the lawsuit.
**If you are a Be customer interested in the class action lawsuit you can send an email with contact information to plaintiff's attorneys at: gonnabe@eplaw.us. Note: The plaintiffs attorneys will not contact you at this stage of the case unless records identifying Be's customers have been lost or destroyed.

BeOnTv/Monterey Financial Service's LOSE! Erik DeSando what's going on? Are you the grinch that stole Christmas!
Hey,
I finally got my money back from MFS. They fought a good fight. We won all our money back. They only sent me what they took from me. So now bee still owes me $1665. Have you heard anything on the Class Act?
Take care
Angel
Angel contacted me months ago and felt that he would never see his money. He took those people to court and WON! How did he win..because he was able to prove that they were WRONG in what they were doing to hard working families!
Now for the latest business run by Mr. DeSando and company. Yo,Erik remember when you were bragging about how much you made in Texas? By the way,I love the web site you set-up. Maybe you can explain to all the hard working, non scamming parents in Texas, that You,Adrian,Sean and Paige felt good about taking their money, then just setting up a Web Page, where everything is based for the most part in California and no where near TEXAS! Do you feel good treating these folks like fools? How can you continue to make promises you never have any intention of fulfilling? Well Kevin got in touch last night and let me know, that he beat your ass in court. How did he do it? He proved that he tried to cancel within 3 days (as your little tricky contract has on the back!)
By the way Erik, do you know what happened to your other creation, My Talent Services? Come on, I have Adrian R' telling me that he had no clue what you were up to in Texas. Just like I had Domingo C, telling me he had no idea what you were up to in California. What's next, a e-mail from Paige and Sean telling me they never knew what you were up to? Merry Christmas dude, maybe you can explain to some parents and their kids how your promises that were never kept, left them with little to nothing under the tree. Do you care how much $1165- that you took from my family will buy? Thanks for nothing Erik!

Dear
My associate Ms, Brainard. has informed you, via past e-mails.
That *My Talent Service, is not related to BE LLC. or Be on Television Prod?
Our services were simply brought on, to help assist the BE members/families as
needed.
If you are seeing new kids added to the BE web-site, its because we are here to
help assist those families, who were not able to get the needed help from their
"then" BE talent director. As a former BE member and parent, you had first-hand knowledge of that.
, we are answering the phones, returning calls,
returning e-mails, helping the parents to select the best pictures of their
kids, informing parents of *Agent Showcases, auditioning tips, improving their
BE web-page, listening to the kids *one on one with their slate and or monologue
and resume informational's.
- please note, we are simply here helping one family at a time, as they
deserve our help and assistants with their BE web-page/membership.
They are not new members. They are FOUND members. Families that we are now able to
talk to and connect with, one on one. We are here to listen to and to help them with their questions and or concerns.
My Talent Service is not, nor have we taken on ANY new BE members. We are
simply helping assist the BE families daily with their questions and guild them
with respect to their childs membership, agent showcase and talent development.
We are here to SERVICE the BE members of BE. LLC.
And that's what you are viewing. Thank you so much for noticing
Because of your constant viewing and reviewing, we are able to show each parent
who ask, to please look at the BE web-site. For WE are making a difference by
helping the kids work on their BE web-page profiles. And with that in return the
kids are getting the auditions, booking the jobs, getting signed with agencies
and they are getting the best response from casting directors when they submit
for casting calls.
We, hear weekly of kids who are getting audition's for projects, because of the
help we are providing them.
I hope that helps you understand a little more of what we are doing here at
*My Talent Service.
As I said, WE are just here to help the current families that have an agreement
with BE. LLC. And that's what we are doing, and that's who we are helping.
Thank you for your time,
Enjoy your week.
Sincerely,
Martin

We have NOTHING to do with Be on TV Productions nor are we taking new
members. Those 20 or so "new" members that are being added to the
gonnabe.com website are existing members that never received the information
to register from their talent director. Please do your research before
passing on information.

Hello ,
Thank you for your reply to my e-mail, (dated July 27, 09).
RE: The posting on, www.gonnabe.com, in regards to a “free screen test”.
Thank you very much for catching that for us. We will remove this posting immediately from the GonnaBe website.
Please note, with your added monitoring, you have assisted our team in making adjustments to the GonnaBe website.
We are a very limited staff, only four and we are working tirelessly to help all of the Be. LLC members, so your help is very, very appreciated.
After reviewing your past e-mails and blogs. I am noticing an on-going disbelief with who “My Talent Service” is.
With respect to the Be. LLC families and members, Ms. Brainard, was brought on because of her knowledge of the Be. LLC families and her helpful customer servicing to these families. Her knowledge of the Be. LLC families lead the way to her transfer from Be. LLC to
My Talent Service.
, it was much easier to transfer former employees, as you may already know, who know Be. LLC and who already have inside first hand information instead of trying to hire, train, and inform someone else who knows nothing of the former.
I, myself worked in the casting/talent division of Be. LLC. Mr. DeSando asked me to help with the new studio opening during the November 08, holiday season. It was at this time that my services came about with the opening of the new Tarzana office. This was due to my knowledge of the entertainment industry. I worked directly with the talent agents, casting directors, and talent managers.
My background in the industry is vast by 28 years.
When My Talent Service was formed, I was asked to come on-board to help service the Be. LLC. members.
Today, I am able to assist parents and members and give them correct and direct information with respect to the industry.
In regards to your wanting names and the location of My Talent Service, , you and your family are no longer members of Be. LLC. Now, if you and your family were still Be. LLC members, I would gladly give you that information requested.
Again, that information will only be available to active and current members of the Be. LLC family.
It was also brought to our attention the harassing e-mails, blogs, and negative press you are presenting to outside parties in regards to Ms. Brainard. Scott, it is not constructive and/or positive of the current situation. Ms. Brainard is here to help, please do not post negative feed about her. She’s done nothing wrong in helping the families. I am sure your friends, family, employer, and colleagues would be hurt to know that you are focusing such hurtful accusations on an innocent person just trying to help.
Again, thank you for catching that “Free Screen Test” notice.
We will inform the webmaster and remove that section of the GonnaBe website.
Best Regards,

Anti-Scam Bill Passes! AAB1319 PASSES in CA
AAB1319 PASSES in CA
This is the most far-reaching anti-scam bill in the history of the industry. It only applies to CA, but we are looking forward to assisting other states in passing similar laws. This bill outlaws Advance Fee Talent Representation (reps should only get paid on commission-AFTER you work) and regulates several new categories of Talent Services, including:
*Talent Listing Services (websites that post actor profiles and breakdowns)
*Talent Consulting Services (those who charge a flat fee to advise you on how to get into the biz, etc)
*Talent Training Services (acting schools, seminars, workshops, etc).
Paying for a job opportunity is illegal, as is "selling" an agent. This bill was supported by an unprecedented team of law enforcement, the BBB, BizParentz, SAG, and literally every major movie studio. Hollywood is truly sick of scammers!
We'll have more on this law on our website in the future, but you can read the final law here

GoBeOnTV and Be Productions same statement on both sites
Just wanted to let you know of something I found. On gonnabe.com , on the "about Be." page, it has this message:
Be is a multifaceted organization designed to give young artists the resources, services, experience and exposure that they need in order to succeed in the entertainment industry. The company offers actors, musicians, dancers and models opportunities to expand their knowledge and talent while encouraging children to reach for the stars in every aspect of their lives: from schoolwork to social time, from academics to the arts.
Be’s management team is headed by entertainment industry veterans with deep knowledge and expertise in casting, production and talent management, giving the company an insider’s perspective on Hollywood." (from http://gonnabe.com/kids/News/Latest/About-Be.... )
Then, on GoBeOnTv.com 's home page, where it talks about GoBeOnTv, it has THIS message:

My Talent Service Continues the Be Production Scam..Don't continue to throw your money away!

Mom of 6
Roseville, CA
Just read through these comments and wanted to tell you about our experience with MTS at the Concord showcase in August 2009. I had been conversing with Debbie regarding her providing proof of the legitimacy of her company. She said she didn't want to send anything thru the mail or via the web and would bring proof to the showcase. At the showcase, a couple of moms approached asking for proof of their business via the business license. Wouldn't you know it, but after she(Debbie)left her house, she realized she forgot it and didn't have time to go back. She said she would send it to me, but as yet we have received nothing!! We asked for a business card from any of the four MTS people that were there. Of course, they all forgot them. We asked them "knowing the questions that people are having regarding your company, didn't you think it would be important to bring something to show you are legitimate?" They agreed, it would have been a good idea, but they forgot any kind of paperwork. One of the children that went into the showcase came out explaining that one of the women in the room said that the casting director that was suppose to be there was ill and so she was there as her replacement but was new at this process. When I questioned Debbie, Liz and Martin about this comment, they said they were not aware of anyone cancelling. I asked what the names of the people who were there for the showcase. They all said they didn't know because Christina does all the scheduling. We told them we found it hard to believe that they are there all day and no one introduced themselves. They were actually in the room with the supposed agents and casting director and yet as owners of MTS they never conversed with them? They said they didn't. They said we could wait until the showcase was over and could talk to Christina. We waited. When we talked to Christina (after watching Martin talk to her first) she approached us, telling us that the casting director was ill and sent a replacement. While speaking to us, the "replacement" came over to thank Christina for having her. I then asked the replacement about her experience, etc. She gave us some line, but unfortuantely did not have a business card to show us. We then asked Christina who was actually there for the showcase, what companies? She had to go get her binder to look it up. We asked her why she would have to look it up. Didn't she know who was there all day? There was only two other people. After observing the reactions, the body language, the facial expressions to each other, and the obvious overacting and nervousness displayed by Martin, we the parents, that were questioning these people, all came to the conclusion that this is not what is represented and certainly do not believe they are a legitimate company.

Erik DeSando, YOU claimed that in 17 day's you made $110,000 and had 1100 memberships!(if YOU want it,I'll post it!) Wow! If YOU read this blog a little more you claimed that due to "the bad financial climate" that YOU had "no more money" and had to shut all the California offices and turn the company over to "My Financial Services". Too bad YOU have no shame to take care of the people that were taken in California.
What excuse are YOU going to give Texas, when you guy's walk away AGAIN!

HUGE HUGE-FYI!!!
If you have been scammed in Texas and would like to get your money back then contact the Texas Attorney General's Office!! They are investigating and are looking for those that have paid money with checks or credit card!
My wife and daughter were approached at a mall..fed a bunch of bogus information at the casting call about Be on TV's affiliation with Disney and The Suite Life of Zach and Cody and how they would put my daughter on the show and train with Esteban..Adrian R Mante which is not Esteban at all. I filed a complaint with BBB in California and notified the Attorney General in Texas over their business practices and filed a police report of their deceptive and fraudulent scam. I also talked to the management company where they setup residence in Texas and notified them of the impending lawsuits and disgruntled parents that were about to show up at their building. It was an Executive Suites in which they only rented the smallest package possible...basically a place to receive mail. We filed a Reg E Complaint with our bank as a fraudulent charge on our credit card and we are waiting for the results. We have also warned as many people possible using Topix. The last place they were hitting was Austin.keep fighting these people ..its a war with information. Hopefully, the good guys will win.

Suzanne G. has left a new comment on your post
Thursday, August 27th 2009, Austin, TX- My son and I were approached in a chain store about attending a screen test with the possibility of working with Adrian R'mante. The screening is scheduled to take place on Sunday, August 30 from 2 - 6pm at the Clarion Inn Conference Center (2200 S. IH-35, Austin, TX 78704). I found this blog b/c I was trying to find out whether or not this screening was legitimate. Sadly, it sounds similar to other posts I have read of scammed parents. The post card has the picture of Esteban with the two suitcases and the logo from The Suite Life of Zack & Cody. It also has "That Kids Got Talent!" listed on it - I have no idea what this is - a company name or a show. It also lists the name of the individual who invited us - LIZA (along with her phone number). I have scanned the postcard in case you are interested in seeing it. If you think this is the same company operating under a different name, it may help someone else from being scammed.
Best of Luck to everyone!

Concerned Parent in Austin, TX
And More From Suzanne:
My son and I were approached at a Target (FM 2222 & 620) store of all places! The really odd thing is that my son has taken acting classes for the last couple of years at a local legitimate non-profit arts organization. So, we were interested but I also thought it was strange that they would be recruiting in a store. I would have expected them to contact local acting or talent agencies for this. So my spidey sense told me to google them. I looked through quite a few google pages before I found your blog! I don't know if the person who does the web updating for you can do this or not - but I think you can add hidden keywords in the html that will cause your webpage to show up on searches. I first tried googling Adrian R'mante, then the Suite Life... but they both brought up too many results. Then I tried "that kids got talent!" which actually seemed to bring up some you tube videos and some legitimate looking shows. So, I wasn't real sure the postcard I received was a scam or not. I did pull up the website from Biz Parents (not sure this is the exact name) but they had some general information on their website that there are a lot of child acting scams out there. That's when my husband and I decided that we would not take my son to the screening. This morning I real ALL THE WAY through your blog and am now convinced that these are the same people. What did it for me was the posting of June 19, 2009 (see below as I have pasted it in entirety). The contact person and phone number on my postcard IS THE SAME as the one from Dallas in June. The woman in Dallas was contacted on a call-back by someone believed to be named "Castro" from BE. PRODUCTIONS! There is no doubt in my mind now who is behind this! I just hope the word gets out in time to prevent others from being duped!

understood.... the company has been taken over by a conservatorship by the biggest debtor who has a UCC filing on any assets...meaning there is nothing left to return to customers. i have been removed from my position in the company and no longer have any power to help you. my recommendation is to use the services and discounts still available and not waste your time trying to get money from a company that is on the verge of bankrupcy. the conservator is still payintg to provide member benifits so use them!!
good luck

I'm sorry it took so long to reply. EJ is the talent agent I spoke with. The posters were of a Bee show, something for kids and the flyer had Andre rmante On it. I was told there may be a cost about a $1000, but nothing in the millions. Guess his way of making a joke. The pictures on the links you provided is the man I talked to. He is/was recruiting in the Dallas area. Please do not show my name. This guy still has my info. Thanks!

I wish I had found this group before I went in and wasted my whole weekend in Dallas. We got a call back from Erik for the "call back" second interview. After 3 hours of presentation and waiting, we went to a small room and he gave us the membership pricing. By this time, my girls and my husband were too exhausted and hungry, and it sounded too vague like a timeshare, I said, I will think about it and didn't sign up. He said we are the only ones who didn't sign up and everyone else did. I wonder if that is a lie. Probably is. So is there nothing legit about this company? Do the people who sign up actually get jobs?

I so glad I had some down time to do some research this morning before our "call-back", saved us a 2 hour trip to Dallas. I was so upset, I called Channel 11 for a scam alert and Disney Corporate to let them be aware of "Estabans" likeness on the invitations.....Fortunately, my daughter is not that upset... My husband and I were both initally skeptical, but figured we'd at least see what it was all about...Now, we know for certain.

Scott, Unfortunately, they kept the invite, I was going to make a copy, but forgot to before we left to go to Dallas. But the front of the invitation was a very misleading picture of "Esteban" in the bellhop uniform, carrying two suitcases w/ Zack & Cody logo. Almost Identical the the top margin of the The Big Talent Bee website. The phone number on the invitation traced back to a Dallas suburb of Grand Praire.
I even called Disney Corp offices to let them be aware of Copyright/ Fraud type activity, and that Be.was intentionally misleading an association with Disney. My husband and daughter were told at Northpark Mall, that the project had something to do with "Estaban" getting a spin-off series from Suite Life..
Erik said they are making the 'rounds in Texas- Houston, San Antonio, and Austin.I also notified the Houston Chronicle. Their reporter was a bit more interested. I suspect they will target The Woodlands Mall, or the Galleria in Houston.
My husband called Erik back this afternoon and left a voicemail to let him know we were cancelling and why. He told them off pretty well! By the way, Erik is AKA "E.J." in Texas now. We got to interview with him on Sunday, so I guess that makes us "Extra Special" lol...
I am sorry that you and many other people are out so much because of scoundrels such as these. Good Luck in pursuing this.
Another thing, I noticed at the bottom of one of their web-sites that Hilton Hotels was listed as a sponsor, hmmm, we'll see about that tommorrow...
Anonymous has left a new comment on your post "Be On TV Productions in Dallas Texas":
We went to the "casting call" and got a callback. We went to the callback today in Dallas. My spider sense starting tingling when they started to mention the costs involved and I googled "Be On TV Scam". This blog immediately came up and thanks to you I recognized this bull for what it is. They took us into separate rooms and started doing EXACTLY what was described on this site. We bolted. I felt really embarrassed more than anything having almost fallen for this VERY convincing scam. They prey upon your children's wishes and what parent would knowingly refuse to grant your child "Their shot at stardom". These people are scum of the earth and if there were grounds to get a police raid on them while they are here in Dallas I would be first in line to testify against them.

Open Letter to Martin Herrera of My Talent Services
RE: The posting on, www.gonnabe.com, in regards to a “free screen test”.
Thank you very much for catching that for us. We will remove this posting immediately from the GonnaBe website.
When I went to the web site today, that part was missing..but click on studio's and guess what!
http://gonnabe.com/kids/News/Latest/Come-in-and-Get-a-Screentest.html..still there.I, myself worked in the casting/talent division of Be. LLC. Mr. DeSando asked me to help with the new studio opening during the November 08, holiday season. It was at this time that my services came about with the opening of the new Tarzana office. This was due to my knowledge of the entertainment industry. I worked directly with the talent agents, casting directors, and talent managers.
My background in the industry is vast by 28 yearsSo In November of last year Eric DeSando, knew he was moving his operation to Tarzana. If anyone cared about the parents (past and present employees) they would have let us know. No one was told anything. We did not find out until we tried to contact our "talent director" and received a automated e-mail telling us,she no longer worked for Be and that they were moving and closing all Nor Cal offices. I wonder if Mr. Herrera did his home work first and saw these:

In regards to your wanting names and the location of My Talent Service, Scott, you and your family are no longer members of Be. LLC. Now, if you and your family were still Be. LLC members, I would gladly give you that information requested.
Again, that information will only be available to active and current members of the Be. LLC familySo in other words, even though I only got two-thirds of my money back, and Be kept $1175 of my money,I am not worthy enough to be told "who is My Talent Service"..in other words, sorry you were ripped-off.
Sorry, but anything that was posted on this blog is the truth ( remember the saying "the truth hurts") My communication has filled with lies and I am sorry that I hurt someone who seems to be part of it. I refer to this post:

Be Productions..When will the lies stop!
This is a e-mail that was forwarded to me from Channel 5 consumer watch,in there inquiry into my problem with Be Productions:Scott and Maribel, I received this email from Be. Do you think this captures the essence of your position with Barry Falck? I'm not sure what you think the best resolution would be, however I recently read a new piece about the legal mandates for a company like Mr Falck's and when I find the information I'll get it to you.
Don@cbs5 consumer watch.
Hi Don,
This is Liz from the customer service department at Be. Barry and I spoke with Maribel Poggenburg today Thursday, April 30th around 5:00 PM to once again try and come to an agreement. We have offered her a free showcase with some of the top agencies in California. This showcase will be held in Northern California on May 31st with a special celebrity appearance by The Suite Life of Zach and Cody's Adrian R'Mante. We are also shooting production for one of our shows that same weekend which was offered to her as well. Besides offering a free showcase and shoot with a Disney star, we also offered a one year free membership for our website. Our website is a great tool for members to create a resume and profile to send out to castings. Agents and casting directors are checking out our website daily.
This evening when we spoke with her to try and reiterate our offerings, she said "to never call again." All our services and offerings to the Poggenburgs will continue to stand when they are ready. It is a two way street and we will continue to offer our services and help, but they have to be willing to participate.
Thank you for your time Don and if you have any other questions, please do not hesitate to call me at 818-578-7192.
Thanks,
Liz Brainard

!st off, my wife never talked to Liz, she talked to Cristine-Lie number 1
2nd they never told my wife they would be "shooting" production for one of their shows, nor did they say what shows lie number 2
Also,my wife never told Liz Bernard or Christine not to call again..she told Barry Flack-lie number 3
Sorry, but lost in all this blah, blah, blah is the fact that Be hurt more families that you may even realize. I know,I have talked to them. They came to me for help, because no one would help them..NO ONE. If you really wanted to help those families,do some charity work for them, don't continue to take their money. Be went under..My Talent Service took their place, and people are still out. There is no way you can justify what has happened and what continues to happen. and by the way if I no longer am a Be or My Talent Services or whatever the next name is customer,WHY DO I CONTINUE TO GET YOUR E-MAILS? WHY WAS THE LAST ONE FROM LIZ? WHY ARE PARENTS THAT ARE STILL CUSTOMERS,COMMING TO ME,BECAUSE THEY NEVER GOT HER E-MAIL? HOW DO YOU JUSTIFY WHAT YOU ARE CHARGING PEOPLE THAT ALREADY PAID ALOT OF MONEY? I do not expect these questions answered because they deal with the truth..and we all know..the truth hurts..here's his compleste e-mail. Current members,if he does tell you the whole story about MTS let me know.
Hello Scott,
Thank you for your reply to my e-mail, (dated July 27, 09).
Scott, it was much easier to transfer former employees, as you may already know, who know Be.
In regards to your wanting names and the location of My Talent Service, Scott, you and your family are no longer members of Be. LLC. Now, if you and your family were still Be. LLC members, I would gladly give you that information requested.
Again, that information will only be available to active and current members of the Be. LLC family.
It was also brought to our attention the harassing e-mails, blogs, and negative press you are presenting to outside parties in regards to Ms. Brainard.

#2- If you received paid work, what companies was that work with. It is hard to believe that after only 2 months, you received paid work.
